The Royal Decree 99/2011, which regulates doctoral studies in Spain, as well as the Doctoral Studies Regulations of the University of Castilla-La Mancha, include the obligation to publish an electronic copy of each approved thesis in an open institutional repository.
At the same time, these rules provide that, in exceptional circumstances determined by the academic committee of the programme such as, for example, the participation of companies, the existence of confidentiality agreements with companies or the possibility that the results of the thesis could give rise to patents, procedures are in place to ensure that the relevant points are not published.
Deferred open publication of the text of the thesis may also be requested when part of it is to be published as an article or book.
PROCEDURE:
Therefore, the following procedure is established to bring together the exceptions to the rule of open publication for doctoral theses:
- The requester submits an application to this School using the form available below.
- When the embargo sought is for more than 12 months, the request must also be signed by the person in charge of the doctoral programme (section III).
- Taking into account the report issued by the Academic Committee of the Doctoral Programme in question, the grounds alleged by the applicant, and compliance with current regulations, the UCLM International Doctorate School will issue the corresponding decision.
- To prevent publication of part of the thesis in perpetuity, the applicant should submit, together with the application, a digital copy including the content not affected by the assignment of rights, for open deposit, and the bibliographic references of the affected journal chapters or articles that should be excluded from publication in RUIDERA. This type of request also requires the express written consent of those responsible for the doctoral programme, who should sign section III of the application.
The decision will be communicated to the interested person, the programme coordinator and those responsible for the RUIdeRA repository.
